Fincap Financial Group (hereinafter "Fincap") specializes in commercial equipment financing. In the course of its activities, Fincap is required to collect, use and disclose personal information.

  • Identify the employee;
  • Prepare employee payroll;
  • Keep employee files;
  • Prepare tax and government documents for the employee;

Some information can also be obtained from various public sources, such as the company register, social networks and other government sites.

2. SHARING PERSONAL INFORMATION

Personal information that Fincap collects and holds about its customers is only disclosed when consent has been obtained from the customer, except in situations where it is not required by law.

Fincap may, in the course of its activities, share personal information with certain third parties (who are bound by the same privacy obligations to which we are subject), including :

  • certain third parties mandated to carry out certain tasks in the processing of the loan application;

  • certain third parties who provide us with computer, web and data hosting services, who may have access to the personal information we hold, strictly for the purposes of the services they provide to us;

  • government authorities and regulatory bodies, where required by law, and to professionals providing services to our firm (legal advisors, financial advisors, insurance brokers and agents, bankers, accountants, experts).

3. LENGTH OF TIME PERSONAL INFORMATION IS RETAINED

Fincap retains personal information only as long as necessary for the purposes stated in this policy and to comply with its contractual and legal obligations.

4. WEBSITE AND DATA STORAGE

The Fincap website is managed by Momentumm and hosted by Site Ground.The files and personal information that Fincap collects and processes are hosted by Zoho Canada Corporation, whose servers are located in Canada.

5. CONFIDENTIALITY AND SECURITY MEASURES

Your privacy and the confidentiality of your personal information are of the utmost importance to us, and we do everything in our power to preserve it.Fincap is committed to maintaining the highest standards of security to protect the information submitted to us, both at the time of transmission and once it is received.

Measures have also been put in place to ensure that only those who have a need to know, or whose duties reasonably require them to know, have access to personal information.

Despite our commitment to maintaining a high level of protection for the personal information you provide to us, we cannot guarantee that your personal information is safe from breach or hacking, as no physical or virtual storage medium can offer this type of guarantee.

In addition, Fincap cannot ensure the complete protection of personal information transmitted to it through the site and cannot be held responsible for any breach of confidentiality parameters or protection devices integrated into the site.  Consequently, you assume all risks associated with the use of the site, the transmission of data or information, personal or otherwise, via the site, the downloading of documents or images from the site, or the use of hypertext links available on the site, as the case may be.

6. COOKIES

The site uses cookies to ensure its proper operation and a personalized experience.  By visiting this site, you consent to Fincap's use of cookies, although you may refuse them, as described below.

This mainly concerns the following information:

Fincap uses Google Analytics for its website. This service is provided by Google Inc (hereinafter referred to as "Google"). The traffic data collected by the cookies and other unique identifiers relate in particular to your use of the websites (including your IP address), which will be transmitted to and stored by Google on servers in the United States. 8. YOUR RIGHTS

Subject to certain exceptions provided by law, individuals have the following rights with respect to their personal information collected by Fincap:  

  1. Right of Access: The right to access personal information held by Fincap and to receive a general account of our use of such personal information. Upon receipt of a written request to this effect, Fincap will provide a copy of the personal information to the person concerned, subject to the exceptions provided by law. In the event of refusal, Fincap undertakes to inform the person making the request of the reasons for the refusal.

  2. Right of rectification: the right to request rectification of erroneous or inaccurate personal information. Where appropriate, such rectified personal information will also be provided to the parties to whom Fincap is authorized to disclose it.

  3. Right to erasure: the right to request the deletion or removal of personal information in certain circumstances, for example when Fincap no longer needs the personal information for the purposes for which it was collected, or upon withdrawal of consent. Where appropriate, Fincap will, to the extent possible without disproportionate effort, take the necessary steps to inform third parties to whom such information has been disclosed in accordance with this policy of the exercise of this right.

  4. Your Right to Withdraw Consent: Individuals may withdraw their consent to the collection, use and disclosure of their personal information by Fincap at any time. However, upon withdrawal of consent, Fincap may not be able to continue to respond to the individual's requests, including the processing of loan applications.

10. MODIFICATION OF THIS POLICY

Fincap reserves the right to modify the Policy at any time without notice. Any person may consult the Policy at any time on the Fincap website.
